CA- DEATH OF INMATE WHO MURDERED 5-YEAR-OLD BEING INVESTIGATED AS SUICIDE

6-16-2009 California:

State prison officials said today they are investigating a possible suicide in the death of a death row inmate who was convicted of murdering and raping a 5-year-old Antioch girl 26 years ago.

California Department of Corrections and Rehabilitation spokeswoman Terry Thornton said that Larry Graham, 58, was found unresponsive in his cell at San Quentin State Prison shortly after 6 a.m. and was pronounced dead at 6:45 a.m.

Graham was convicted in Contra Costa County Superior Court in 2002 and sentenced to death in 2003 for the murder, rape and sodomy of Angela Bugay, who was abducted from the Antioch apartment complex where her family lived on Nov. 19, 1983. Graham lived in the same complex at the time.

The girl's nude body was found a week later in a shallow grave near the Contra Loma Reservoir south of Antioch. She had been strangled.

Thornton said she could give no details of the Graham's death other than to confirm it is being investigated as a suicide.

Thornton said there are 683 other inmates on death row, with cases in various stages of appeal. Graham's appeal had not yet been heard by the California Supreme Court, the first step in the death penalty appeals process.

The spokeswoman said Graham would be the 17th death row inmate to have committed suicide since California reinstated the death penalty in 1978.

Graham, who had briefly dated the victim's mother, was a suspect in the murder but was not arrested until 1996, when DNA tests linked him to the case.

Graham, a former commercial pilot, was managing an auto repair shop in Concord and had recently moved to the city when he was arrested in 1996. ..Source.. by Julia Cheever

Death-row inmate a possible suicide in San Quentin

6-16-2009 California:

SAN QUENTIN — A convict awaiting execution in the 1983 kidnapping and murder of a 5-year-old Contra Costa County girl was found dead in his death-row cell early Tuesday, officials at San Quentin State Prison said.

The body of 58-year-old Larry Christopher Graham was found unresponsive, prison officials said. The death is being investigated as a suicide.

Graham was sentenced to death in Contra Costa County in 2003 after DNA evidence linked him to the murder of Angela Bugay.

The girl had disappeared Nov. 19, 1983, from her family's Antioch apartment complex. Her body was found a week later in a shallow grave several miles away.

In 1996, DNA technology allowed authorities to link Graham to evidence found on Bugay's body.

Bugay's mother had briefly dated Graham and the child trusted him enough to allow him to take her, authorities said at his sentencing.

Defense attorneys unsuccessfully argued that Graham's dysfunctional upbringing by an alcoholic mother, and father who had been convicted of child molestation, should keep him from death row.

At the same time Graham was on trial for the Bugay killing, his son, Larry Christopher Graham Jr., was being tried for the murder of Anthony Frank Buccellato, 57, an Antioch man he pushed off a speeding truck into Highway 4 traffic in 2001. Graham Jr., charged with an accomplice, said during his trial that he had beaten Buccellato and was taking him to the hospital when he realized he was already dead, so he pushed him off the truck.

Graham Jr. unsuccessfully argued at trial that he wasn't trying to rob Buccellato but was punishing him for making sexual advances at a teenage girl, who testified that Buccellato was indeed being set up for a robbery.

Graham Jr. was convicted of first-degree murder and robbery and sentenced in June 2003 to 26 years, 8 months to life in prison. ..Source.. by Robert Salonga, CONTRA COSTA TIMES

Killer of Antioch girl is found dead in cell

6-16-2009 California:

SAN QUENTIN -- An Antioch man who was sentenced to death in 2003 for raping and strangling a 5-year-old girl two decades earlier was found dead in his cell at San Quentin State Prison this morning, an apparent suicide, officials said.

Guards found Larry Graham, 58, unresponsive at about 6 a.m., and he was pronounced dead 45 minutes later, said Terry Thornton, spokeswoman for the state Department of Corrections and Rehabilitation. She gave no further details.

Graham's victim, Angela Bugay, was kidnapped from her family's Antioch apartment on Nov. 19, 1983. Officers found her nude body a week later buried in a field a few miles away. It was one of a series of baffling and frightening child abductions in the Bay Area during the 1980s.

The crime went unsolved until 1996, when new DNA evidence led to the arrest of Graham. He lived in the same apartment complex as Angela, had briefly dated the girl's mother before the killing and had a history of sexual offenses against children.

A Contra Costa County jury returned a death verdict against Graham in October 2002, after a three-month trial, and then asked the judge for directions to the cemetery where Angela was buried.

Graham was sentenced to death in January 2003. The state Supreme Court had not yet heard his appeal at the time of his death.

Thornton said Graham would be the 17th Death Row inmate to have committed suicide since the state reinstated the death penalty in 1978. During that period, she said, 45 condemned prisoners have died of natural causes.

California has executed 13 prisoners under the current capital punishment law, starting in 1992, and has 683 under death sentence. ..Source.. by Bob Egelko, Chronicle Staff Writer

AR- Tucker inmate found hanging in cell

6-14-2009 Arkansas:

An inmate was discovered hanging in his cell at the state Department of Correction's Tucker Unit on Friday morning.

Jessie Garcia, 48, was found at 7:20 a.m. suspended by a piece of material that had been looped around his neck and tied to a low bar of his cell, Correction Department spokesman Dina Tyler said. It seemed that Garcia had sat down after creating a noose and tying the cloth to the bar, she said. She assumed the cloth was a sheet, she said, but didn't know for sure.

The death appeared to be a suicide, Tyler said. However, she said Garcia hadn't previously "exhibited any outward signs, including any verbal indications" of being suicidal. Garcia was the only occupant of his cell.

"He did have mental health as well as medical issues, and those combined with the length of his sentence could have played a role in this," Tyler said. Garcia had a seizure disorder and had been in the prison's infirmary Thursday night after reporting having had a seizure, she said.

Garcia was serving a 20-year sentence in the rape of a minor, according to court documents. He had been sentenced by the White County Circuit Court. He began his sentence on June 12, 2003. He would have been eligible for parole in 2017, Tyler said. In 1988, he was sentenced for robbery and property theft.

Tyler said a guard had last checked on Garcia 20 minutes before he was found. He had a history of disciplinary problems and violence at the prison, most recently violating assault and battery rules June 4, she said. ..Source.. by SAMANTHA FRIEDMAN

SC- Man wanted on sex charge found dead in home

6-11-2009

A man wanted on a criminal sexual conduct charge was found dead inside his Ansel Street home Wednesday when Richland County sheriff’s deputies forced their way inside to serve him a warrant, authorities said.

Thomas D. Montgomery, 47, had at least one self-inflicted stab wound to the chest. He was pronounced dead at the scene at 1:15 p.m., Richland County senior deputy coroner Ted Powell said. An autopsy is scheduled for today.

A fugitive investigator told Montgomery over the phone Wednesday morning that there was a warrant for his arrest, sheriff’s spokeswoman Deputy Monique Mack said.

Montgomery was charged with criminal sexual conduct, accused of sexually assaulting a 47-year-old female acquaintance May 21, Mack said.

He acknowledged his identity over the phone, then hung up, Mack said.

Members of the department’s Fugitive Task Force surrounded the home about 12:15 p.m. to serve the warrant and announced themselves, knocking on the front door and ringing the doorbell, Mack said.

They heard movement inside and waited an hour for Montgomery to come out, Mack said.

“We always like to give them every opportunity to come out before we make entry,” she said.

When he didn’t come out, deputies forced the locked back door and found him dead on a bedroom floor, Mack said.

No one else was inside the home east of Two Notch Road near Pinehurst Park.

Montgomery did not leave a suicide note and deputies had no reason to believe he would harm himself, Mack said. ..Source.. by LEE HIGGINS

TN- Overton inmate found dead

6-8-2009 Tennessee:

LIVINGSTON -- The TBI is investigating the death of an Overton County jail inmate on Friday.

Thomas Morgan, 71, of Smyrna and formerly of Overton County, was being held on charges of sex offenses against a child, according to Assistant District Attorney Owen Burnett.

He had been picked up by authorities in Smyrna on Thursday and turned over to Livingston Police Chief Greg Etheredge and DA's Investigator Terry Hembree, who brought him to the Overton County jail that night.

Etheredge said that sometime in the early morning hours of Friday, Morgan was found in his jail cell suffering from an apparent suicide attempt in which he had tied a bed sheet around his neck after connecting the sheet to some type of fixture in the cell.

He was taken to Livingston Regional Hospital, where he died.

Morgan had lived in Overton County for a time and had recently moved away, Etheredge said.

Etheredge and Hembree began an investigation of him after the mother of a young girl filed a complaint alleging that Morgan had sexually molested the girl. The charges on which Morgan had been recently indicted included rape of a child and aggravated sexual battery.

"Investigator Hembree and I went to Smyrna looking for him after the grand jury here indicted him, but we could not find him at that time, which was on Wednesday," Etheredge said.

The next day, the Smyrna Police Department did find Morgan, and Etheredge and Hembree returned to Smyrna and transported Morgan back to Livingston.

Burnett confirmed that Morgan had been jailed in Overton County around 9 p.m. Thursday, his bond set at $100,000, and that he was found unconscious in his jail cell later that night.

Allegedly, Morgan had a record of sex offenses in California, Etheredge said.

KS- CraigsList" Rapist Found Dead in Segwick Co. Jail

6-8-2009 Kansas:

A man recently found guilty of raping women while posing as a police officer has been found dead in the Sedgwick County Jail.

David Gage, 52, had been in custody since August, 2008 and was recently convicted on felony charges. Gage was awaiting transfer to the Kansas Department of Corrections.

Gage was sentenced to 29 years in prison last month.

Police said Gage would meet his victims in the erotic services section of the website Craigslist. Officers said Gage would meet the woman at Wichita motels and then show a fake badge or gun, telling the women they'd be arrested if they didn't have sex.

In a news release, the Sheriff's department said an inmate observed
Gage in his cell early this morning and informed the detention deputy on duty. Gage was alone in his cell and the preliminary investigation indicates the death is likely a suicide.

Major Glenn Kurtz told KAKE News Gage hanged himself. The investigation is still on-going, and it is not clear what he used. Kurtz also said Gage showed no signs of depression.

During his sentencing hearing Gage spoke to the judge saying, "In all probability your honor, this is a death sentence for me."

There have been twelve attempted suicides in the Sedgwick County detention facility since 2008. During the same time period, two inmates have died from natural causes. ..Source.. by KAKE News

Man Arrested For Impersonating Marshal, Sexual Assaults

8-4-2008 Kansas:

Friday, Wichita police arrested 51-year-old David L. Gage at a motel in the 8900 block of West Kellogg. They say he raped a woman he contacted on Craig's List. The victim told police Gage showed her a badge and police scanner, claiming to be a U.S. Marshall.

Police began investigating last week, after receiving a tip posted on Craig's List. The tip warned women and escorts to be careful of a man going by the names David and Lee. The warning said he would meet women, pull out a badge, gun and handcuffs; claim to be a cop and threaten to arrest his victims unless they had sex with him.

In at least one other incident, it's believed he also robbed a woman. "We know he used a false badge... as part of his ploy," said Wichita Police Capt. Brent Allred on Monday. "We believe there are additional women out there who have met this individual and been involved in these situations."

While police know of two cases, they believe there could be additional victims. If women have information about similar incidents they can call the Wichita Police Sex Crimes Division at (316) 268-4156.

Investigators say Gage has been in trouble before. In the late 90's, police say Gage was charged with misdemeanors after trying to solicit sex from an undercover police officer. He could now face felony charges when officers present their evidence to the District Attorney later this week. Gage remains in the Sedgwick County Jail on a $500,000 bond. ..Source.. by Cayle Thompson, KAKE News
